This isn't some dusty regulation nobody uses. The pre-tax benefit alone lets you pay for BART, Muni, or Caltrain with dollars that haven't been taxed — which, in a state that already takes a generous bite of your paycheck, is nothing to sneeze at. One Bay Area commuter described using a vanpool program where their employer leased an SUV, reimbursed most costs, and left riders splitting gas between four to six people. "My monthly cost with the gas price increase is about $40," they said. "There was a time when it was $0."
Not bad for a government mandate, honestly.
But like most things in Bay Area bureaucracy, there are rough edges. As one local put it, the telework option basically means "one day working remotely, four in the office — so not really helping in this day and age." That's a fair critique. The program was designed in a pre-pandemic world and could use a serious update. Another resident summed up the general mood pretty perfectly: "If any of those things can make me less poor, I'm in favor of them."
Look — we're usually the first to side-eye mandates that tell businesses what to do. But this one is already on the books, your employer is already supposed to be offering it, and the pre-tax option in particular costs companies essentially nothing. The real scandal here is that so many employees are leaving free money on the table simply because nobody told them it existed.
So do yourself a favor: ask your HR department this week. If they look confused, point them to 511.org. And if your company has 50-plus employees and offers nothing? That's not just stingy — it might be illegal.
